END USER LICENSE AGREEMENT
IMPORTANT – PLEASE READ CAREFULLY:
This End User License Agreement (“Agreement”) is a legal agreement between you (“End User” or “You”) and EduFit (“Company”). By downloading, installing, or using the “EduFit” app and services (“App”), you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the App.
- LICENSE GRANT
The Company grants you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on any Apple device that you own or control, in compliance with Apple’s App Store Terms of Service.
You may not rent, lease, lend, sell, redistribute, or sublicense the App. You may not copy, reverse-engineer, disassemble, or attempt to derive the source code of the App. Any violation of this Agreement may result in the immediate termination of your right to use the App.
- USE RESTRICTIONS
You agree to use the App only for lawful purposes and in compliance with all applicable laws and regulations. You may not use the App in any way that:
- Harms, disrupts, or interferes with the App or any third-party services;
- Infringes upon the intellectual property rights of others;
- Collects or stores personal data of others without proper authority.
- DATA COLLECTION AND PRIVACY
The App may collect certain personal data, including location data, IP address, and usage statistics, as described in our Privacy Policy. By using the App, you agree to the collection and use of this data. The Company ensures that your data will be treated in accordance with all applicable data protection regulations, including GDPR if applicable.
- IN-APP PURCHASES AND SUBSCRIPTIONS
The App may offer certain features or services for a fee, including one-time purchases and recurring subscription-based services (“In-App Purchases”). If you choose to make an In-App Purchase, including a subscription, you agree to the pricing, payment, and billing policies set forth by Apple. All In-App Purchases, including subscriptions, are processed through Apple’s App Store, and you should refer to Apple’s payment terms for any billing or refund questions.
Subscriptions automatically renew for the same price and period unless you disable auto-renewal through your Apple account settings at least 24 hours before the end of the current subscription period. You will be charged for the renewal within 24 hours before the subscription period ends.
You can manage your subscriptions and turn off auto-renewal by going to your account settings on the App Store after purchase. Deleting the App does not cancel your subscription.
Refunds for In-App Purchases and subscriptions are subject to Apple’s policies. For more information, refer to the App Store’s refund policy.
- INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights in the App, including any updates, modifications, and improvements, belong to the Company. You do not acquire any ownership interest in the App by downloading, installing, or using the App.
- TERMINATION
This Agreement is effective until terminated by either you or the Company. Your rights under this Agreement will terminate automatically if you fail to comply with any terms. Upon termination, you must cease all use of the App and destroy all copies, full or partial, of the App.
The Company reserves the right to suspend or terminate access to the App at any time for any reason, including violation of this Agreement or suspected misuse of the App.
- DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Company does not warrant that the App will function uninterrupted, secure, or error-free, or that the App will meet your requirements.
- LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no event shall the Company or its affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost data, lost profits, or any other damages arising from your use of or inability to use the App, even if the Company has been advised of the possibility of such damages.
- GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is based, without regard to its conflict of laws provisions. Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of the jurisdiction’s arbitration authority.
- THIRD-PARTY BENEFICIARIES
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement as a third-party beneficiary.
